Yes this is not Afenis fault. Its Dina the Dyke and her army of graverobbers, what is so sad about this is im not surprised... at all! And Rukas if she tries to sue you from using the word Tupac .. get a lawyer and im pretty sure you will win.

I spoke to Dina Lapolt before. Shes a real bitch. She said she had nothing to do with the decisions regarding his music, but made money decisions and worked on things like the Tupac Amaru Shakur center.
 
FFS read intellecutal copyright laws and understand, the basic form is straightward.. when there's one pure fan doing it for a good cause there's 100 bootlegger clowns doing the same with ill intent. to the eyes of the lawyers you're 101, its business, they could care less what we think. ppl sell T-shirts at the markets all the time, and they get away with it because the lawyers and those who try to prevent such things cant attend every market all the time. Von Dutch ripoffs are everywhere

There's a BIG difference between selling unofficial Tupac T-shirts in small swap meets across the world and on the internet.

In swap meets you sell them locally (obviously somewhere where the estate isn't at); on the internet, you sell them internationally, makign yourself known to the world. Like the Estate wont regularly sue a person selling a fake Pac shirts in a swap meet in, lets say, Dallas or Japan cause they wouldnt know. But on the internet, all they have to do is go to a (popular) website like this one and find out.
 
James Earl Jones, the voice of Darth Vader from Star Wars, said that he actually is not allowed to talk like Darth Vader in public, since LucasFilms owns the rights to it. If someone can own the rights to a voice, then it makes sense that someone could own the rights to a face.

yup...same goes to the lady who does Bart Simpson's voice. She cant talk like that in public. Same reasons...
 
I'm no expert, but i think if u just had pac's face, not name u could get away with it. I know she sued to have tupac's estate....which i think means that u cant use his name, product on anything....I'm sure if there is a loop hole somewhere, just keep lookin lol
 
Theres probably a million or so solutions to this problem. Some will get you sued, some won't. The simplest solution I've come up with myself is quite frankly to just change the image. Personally I've never been a big fan of apparel with pac's face on it. I always thinks it looks rather cheesy in the end. My suggestion is that you go with something that scream 2pac, but isn't 2pac per se. For instance... the black and white logo at the top of the main 2pacboard page is an excellent start. It's not tupac, yet anyone in the know will know exactly who it is. Changing up the design of that type of print would get you some varience and yet keep Amaru off of yor back. Furthermore, I personally would like to see something with like a bandana tied in front like pacs hanging off o the letter "T" in tupac. And if you wanted to get further into it, hell even add dripping blood or something like that... fans of 2pac will know what the hell your referring to, and will "get it" and you won't have to deal with the hassles of using a likeness. (Which, yes is copyrightable.)

My last bit of advice for you though is to just be carefull... Your marketing these in america, the same country that allowed Paris Hilton to copyright the phrase "thats Hot". Keep that in mind, because if someone can copyright a spoken phrase commonly said millions of times prior to it's copyright, then you better believe just about any visual image can be copyrighted as well.
 
I think the product would be a lot better and more popular if it were Free Tupac shirts instead of FreeTupac shirts.
