Seems like a no-brainer to me, use his name for merchandise and you're opening the door to the courts. Put Brad Pitt's picture on it and what would happen? Exactly.

Ive been CafePress.com'ing and it took Afeni less than 12 hours to sue me over the use of Tupac's face on a T-shirt.

Answer me this, how can someone get away with putting Bush's face on a shirt, putting the Pope's face on a shirt, but not Tupac's? How the hell can Afeni copywrite someones face?

It's on the internet, so it is ok to use it.
FALSE. Simply because an image is found on the internet does not mean that it is in the public domain. Unless the author of the work has explicitly stated that his work is "public domain" or that the copyright has expired because the work is very old, then you must assume it is not. Further, a person who posts an image on the internet and claims that you are free to use it may not have had the right to post the image in the first place. Thus, your use of the image may violate the rights of the actual copyright owner.

It is Fair Use.
USUALLY NOT. Fair use of a work for the purposes of merchandise sale is treated very differently than for informative purposes or for commentary. In general, a claim of fair use of a work when it is used on merchandise may not hold up in court, especially if the merchandise is sold for profit.

I took the photo, so I can use it however I want.
FALSE. Simply taking a photo of a person, company, brand, logo or the like does not afford you the right to sell merchandise featuring that photograph. There are two distinct intellectual property rights in a photograph: (1) the rights in the photograph itself and (2) the rights in the subject of the picture, such as the product or person shown in it. For example, if you take a photo of a car or celebrity, you only own the rights to the photo, but not the right to use the photo of a celebrity for merchandise sale. In order to sell merchandise with the image, you will need to obtain explicit permission from the celebrity.

pretty much the FAQ at CafePress.com says it all.. it's always advisable to read about intellectual property laws before doing anything questionable.

1. I removed Pac's face as you can see in the example and am waiting to see what they say about using the word Tupac, they cant own the word Tupac, its a name. My shirts could be about Tupac Amaru the Incan chief for all they know.

2. Dude do you have any idea who i am? Ive been reinvesting money I make in real life back into HitEmUp/2Pacboard/StreetHop for years, what would make this any different? Shut up.

You know what? Just write Afeni a letter tell her a lil abot you what your doin, tell her you're sorry & shit and that you didn't want to make a profit etc... Perhaps she'll love you and it's Ok :thumb:

damn afeni is realy not making herself more popular to the fans, I was always like its still pacs mother, she raised him to what he was, and he loved her for that, but Im realy starting to lose my respect for her.
we the fans are repping pac more than she does, we make alot of new fans, and that boosts the album sales.
and you making a shirt of pac ( and this whole website) is another way to rep him and get more fans, she should give you money for what youre doing for pac instead of sueing you, and she knows youre right with that whole free tupac thing.

she wants all tha money, so she wants to get rid of anything that she can't make money off of. afeni stop coming after this stupid bullshit and try worrying about makin a good album for a change.

Im not being funny , but what would you do Rukas if someone started selling hoodies with streethop.com on it or made money of your work/name ? , hasnt some other sites been using your ideas on there board ? were you happy with that ? remember pac hitting out at that bootlegger in N.Y. - I like the hoodie you did and believe in the cause and this is not an attack on you but afeni has people to keep an eye on 2pacs legacy for better or for worse for the great man and they stepped in , i think you should take the hit on the chin and keep up the good work . peace
