OK, this is going to be a series, where I show you where some famous samples come from.

So, everyone knows that Kanye sampled Daft Punk's 'Harder Better Faster Stronger' for his track 'Stronger'.

Although, he wasn't the first hip-hop producer to get their hands on that track - The Neptunes did an official remix of 'Harder Better Faster Stronger' which was released on Daft Punk's 'Daft Club' remix album over 5 years ago.

But I digress.

Did you know that the Daft Punk song was originally sampled from Edwin Birdsong's 'Cola Bottle Baby'?

I wonder if Pac wrote and got the permission to use that sample, logic tells me he didn't . But if that is the case, that 2Pac didn't get any kind of permission to sample that hook, wouldn't it stand as plagiarism? We are dealing with a different kind of sampling here, not just sampling beats, baselines, melodies, or chord progressions. This is sampling other artists rhymes. The law on sampling rhymes is a lot more of a difficult case. Eminem is a fiend for it, he is the worst. And weather he gets permission from Snoop to rap "listen close to what we say, because this type of fag claims to never be gay" Eminem 'Quitter' - sampling Snoops Doggy Style, reforming Snoops words for his own. So what, Eminem does it mostly in unreleased/unofficial songs. It is still sampling. One more thing about Hit Em Up and its genius that aside from sampling Junior Mafia's - Players Anthem, the lyrics were written in a way that wasn't libelious or slanderous towards Biggie, it was done indirectly. Eminem on the other hand, I don't know how he gets away with it!

I made an entire thread about this very issue a couple of years ago.I'm not sure if it was on this board though, or another.

Basically, a similar instance occured between Limp Bizkit and Nine Inch Nails.

Fred Durst of Limp Bizkit and Trent Reznor of Nine Inch Nails were beefin'. When Limp Bizkit released their album "Chocolate Starfish and the Hot Dog Flavored Water", the first track "Hot Dog" ripped off the hook from NIN's "Closer" and Fred had flipped it around to diss Trent.

Then you look in the credits for the album and the track said "Written by F.Durst and T.Reznor".

Basically, Trent allowed them to rip his hook and diss him, but demanded a writing credit on the song so he would get shitloads of royalties from a song that was cussing him. Fred had to agree or the song wouldn't have got released.

Trent is a smart man.

So yes, there is absolutely scope for Biggie's estate to sue Pac's estate over the ripping of the hook for "Hit Em Up". I don't think Voletta Wallace would do it, because it seems her and Afeni Shakur get along, but if she wanted to.....she could.
