Anyways, here's a little update on dude who hit Sullivan.

Bail was set at $75,000 Tuesday for a Kershaw County man charged in what police say was an alcohol-related collision that killed a 5-year-old boy on his bicycle.

Donald Earl Brown, 42, was charged with felony DUI in the Father’s Day crash that killed Sullivan Daniel Spradley. Brown was driving a 1998 Jeep that struck Sullivan in front of his rural Kershaw County home about 9 p.m., authorities said.

A state Highway Patrol trooper smelled alcohol at the scene, but Brown refused to take a Datamaster breath test or blood test, said Zack Atkinson, assistant solicitor for Kershaw County.

“He ... was very uncooperative with law enforcement,” he said.

The Highway Patrol had to get a search warrant from a magistrate to obtain Brown’s blood and urine samples. This is not a common procedure, said Atkinson, but the Highway Patrol took “this additional step to make sure they’ve done everything right.”

The blood-alcohol results, which will not be available for three to four weeks, will be turned over to the Highway Patrol and solicitor’s office, he said.

Brown’s bail does not have a 10-percent option, which means he must come up with $75,000 in cash or property before he is released from the Kershaw County Detention Center, Atkinson said.

One of the reasons this was done was because of Brown’s proximity to the boy’s family, Atkinson said. The Browns and Spradleys live several miles apart on Shivers Green Road in Ridgeway. Also, Brown could be a flight risk because a background check revealed he had several aliases, Atkinson said.

If convicted, Brown faces a mandatory prison sentence of one to 25 years. He would have to pay a fine of at least $10,100 up to $25,100, and would not be eligible for parole. His driver’s license would be suspended during his imprisonment and for three years after that.

Brown is represented by Camden attorney William Tetterton. When asked why his client would not take the blood and breath tests, Tetterton said Brown “probably was upset himself” and may not have known what the officer wanted him to do.

Ok, his lawyer better have a better defense than "he was probably upset himself and may not have known what the officer wanted him to do". I hope this fucker gets the max on this one. Everybody was telling me, when I seen dude's pic I'd recognize him from coming in where I work and that he's always drunk and smelling like a brewery. And when I seen it, I did recognize him. He comes in all the time and there isn't a time that I can remember that he wasn't either drunk or smelling that way.
