DMX caught a break in a recent lawsuit against him. A judge vacated the $1.5 million award to a woman who filed a defamation suit against the rapper after he alleged that she raped him – though on a technicality.
The judge ruled that DMX, whose real name is Earl Simmons, was not properly served with court papers.
Monique Wayne gave birth to the rap star’s son in April 2004, but the lawsuit came in 2006 after DMX claimed that “she” raped him while he slept. Wayne denied the claim and filed suit saying, “he lied to the whole world on me.”
Wayne was awarded the $1.5 mil when he failed to appear in court. But Simmons’ lawyers said he was not aware of the case because he was not properly served. His lawyers also said they are looking forward to disproving the case, should it continue in court.
DMX is clearly keeping his law team pretty busy. He’s facing criminal charges in Arizona for allegedly mistreating pit bulls and for a felony drug possession. He’s pleaded not guilty.
