A Gardiner woman previously convicted of encouraging her 18-month-old daughter to smoke marijuana was sentenced Wednesday to five years in prison.

A federal judge in U.S. District Court in Billings also handed 24-year-old Jessica Lynne Durham four years probation. The ruling came almost eight months after she was found guilty of distributing marijuana to a person under the age of 18.
That ruling, reached by U.S. District Judge Richard Cebull, was a result of a one-day trial before the judge, who heard the case without a jury. At the time, Cebull told the Associated Press, "I haven't seen a case like this."

According to court records, Durham told her friend, Brandi Nichols, also of Gardiner, to take photographs of her toddler smoking pot out of a bong, saying it would be "cool" to send the pictures to High Times, a marijuana magazine.

Nichols also testified at trial that Durham let her daughter smoke marijuana because the little girl wasn't eating or sleeping enough.

Because there is no parole in the federal system, Durham will at least serve 85 percent of her five-year sentence.

i knew a girl that was a few years older than me when i was in high school. she use to sit her kid, who was around 2 years old, in the bathroom of her parents house and blow bong hits in her kids face.

a few years later she was having a party. her son was about 4 was in a room with us when we were about to smoke a blunt. she asked everyone "who wants to spark the blunt"? everyone just looked around at each other for a few seconds and then her son says "I DO"

1) No, I wasn't joking. Its a fact that weed helps insomniacs sleep, and helps people with no appetite eat - so why not? Like Chrondike said U'd rather ur kid starve 2 death?
2) Yeah you're right, a small child can't handle a bong hit...but its not like the kid was ripping the bong himself. He had the hit blown in his face...oh no, boohoo...maybe he coughed a lil bit - got higher, ate some more, then went to sleep. Problem solved.

Come on man, there are plenty of other ways to get a kid's appetite up and help them sleep, take your kid to the doctor. Don't smoke weed with them.
