Etzer Estiverne, 26, was arraigned on Tuesday evening. Estiverne's wife, Natasha, told police that when she got home from work late Monday night, her 9-month-old son and 3-year-old daughter were asleep. But hours later, they were at Nyack hospital and the 3-year-old daughter Melanie was dead -- and the husband is now charged with murder.
Even the most hardened police investigators are having a tough time dealing with the crime in the basement apartment of the Estivernes' home.
"It's sickening and to go up there and to look at this 3-year-old girl and see her lying in the hospital. It's just mind-boggling," said Lt. John McAndrew, of the Orangetown Police Department.
Estiverne confessed to killing his daughter because she wouldn't eat her dinner, a peanut butter sandwich. That was at 8 p.m. on Monday. The mother was at work at Target when the slaying occurred.
Seven hours later, emergency room workers at Nyack Hospital said the girl's lifeless body was brought in by the parents -- dead on arrival. Melanie Estiverne had multiple internal injuries to her vital organs. The father said the weapon was his fists.
"The history is that she has a problem eating, especially with him. He was trying to feed her the sandwich and she was not receptive, and he just went off," said McAndrew said.
Natasha Estiverne is not facing any charges, and currently, the 9-month-old son is with child protective services.

HIGHLAND PARK, N.J. -- A Middlesex County woman was charged Tuesday with drugging and smothering her 6-year-old son.
Alice O'Donnell, 43, was charged with murder in the death of her son Phillip.
An autopsy was to be performed Wednesday, but a preliminary investigation determined the child died from a combination of an overdose of over-the-counter medication and suffocation by a pillow.
Middlesex County authorities said the mother had self-inflicted injuries when police arrested her Tuesday, but did not require medical attention.
Police responded to a 911 call placed shortly before 1 p.m. Tuesday from the Donaldson Park Apartment complex, where O'Donnell and her son had lived since October. When officers arrived, they found the child's lifeless body in a bedroom.
Phillip O'Donnell was last seen playing outside at 5 p.m. Monday.
Authorities said the boy's mother made statements to investigators that led to the filing of a murder charge, but would not specify what was said.

FORT WORTH, Texas – The bodies of a missing pregnant woman and her 7-year-old son were found Tuesday, hours after an ex-boyfriend was arrested and charged with murder, authorities said.
Bagel shop owner Lisa Underwood and her son, Jayden, were reported missing after she failed to show up at her baby shower Saturday. A pool of blood was found in her home, but there was no sign of forced entry, police said.
The bodies were found near Denton, about 30 miles northeast of Fort Worth, police Lt. Gene Jones said Tuesday. Underwood's SUV was found in a creek near the town on Monday.
Stephen Dale Barbee, 37, of Fort Worth, was arrested Monday night in Tyler, and Fort Worth police were bringing him back to Tarrant County. Jones said he didn't know why Barbee was in Tyler, how investigators knew to find him there or whether there were other suspects.
Acting on an anonymous tip, police had searched a Fort Worth home during the night and found an item referred to by the tipster, but officials would not say what it was or how it figured in their investigation.
Police did not immediately establish a motive for the killing, Jones said.
"We know that at one time Mr. Barbee and Ms. Underwood were romantically involved. We don't know what the latest status of that relationship was," he said.
Jones said he didn't know who was the father of Underwood's fetus, but a neighbor of Underwood, Debbie Lindley, said it was Barbee. Underwood and Barbee met about two years ago but split up last fall because Barbee had another girlfriend, Lindley said. She didn't know of any violent incidents between the couple.
