"Hate speech" isn't an easy thing to define. Is it "hate speech" to say that homosexuality is wrong? Does it matter whether that's your personal opinion or a part of your religion?

If you can protest against gay rights while holding a Bible, why can't you protest against Jewish rights while holding Mein Kampf? They're both doctrines, they're both beliefs that certain people hold. Is one more acceptable than the other because it is supposedly passed down from God? Is one more acceptable than the other because anti-Semitism isn't generally acceptable any more, whereas homophobia still is?

Hate crime laws are at the heart unconsitutional. They do not just punish the crime, they punish the motive behind them and infact are punishing the offenders personal beliefs. I think all crimes should be looked at equally regardless of motive, the crime is all that should be judged. You may not agree with racist, gay-bashers, bigots, etc... but laws should not be able to govern their opinions.

They prosecute the crime based on what was in the offenders mind instead of just the crime. To me that is the same thing. Assualt is assualt, manslaughter is manslaughter. The physical crime is all that should be taking into account when deciding on a sentence.
