Grand Jury Indicts Gerald Levert

*After a prosecutor said there was not enough evidence to charge Gerald Levert of assault following a February confrontation with police in Cleveland, a Cuyahoga County grand jury on Tuesday indicted the R&B singer on two charges of felonious assault and a charge of obstructing official business stemming from the incident.

Police said Levert and a passenger in his car, James Austin Jr. of Canton, interfered when authorities stopped a friend of Levert's for speeding at 12:45 a.m. Feb. 25. Patrolmen Ronald W. Ross said he hurt his wrist and Daniel Lentz said he injured his shoulder while trying to detain Austin.

The grand jury indicted Austin, 27, on the same charges as Levert and a charge of assault on a police officer.

After the initial incident, Levert, 38, was charged with drunken driving, impeding traffic, obstructing police business and resisting arrest; but days later, prosecutor Anthony Jordan said that there was no evidence the singer caused serious physical harm to police officers Ross and Lentz.

Levert, son of The O’Jays singer Eddie Levert, is scheduled to be arraigned on March 22 in Common Pleas Court.
