A car smashed into me.

Okay guys, here's the fast version.

A car ran the stop sign and ran into my car.

I need a new fender, bumper, hood, and probably a door because i can't open my driver door anymore.

Anyways, this is my question. I know it's illegal not to have insurance on your car in the state of Illinois. It's also illegal i'm sure to print off fake insurance cards off the internet.

So this kid sticks around while we wait on the cops to come so we can fill out the police report (only because his axle was broke and he couldn't drive off) and we get everything taken care of.

Only to find out, once I call his insurance company that he gave fake information, fake policy number, etc.

So, what actions can I take, I know i'm going to have to use my own insurance to get my car fixed, but, i'm wondering, isn't there some other type of legal action I can pursue.

I have his VIN number, license plate, ID number, and year/make/model of car.

Any help is greatly appreciated!!!!!!!!

i actually used to drive around with fake insurance lol... i felt like i was a good enough drive to do so...

But he didn't give it to me, he gave it to the police officer, it's on the police report that that the officer filled out, so isn't that enough proof? or no?
 
kid = parents parents=responsibility.

Is this kid under 18 years of age? Also the police filed a report about the incident, go to your police department and give them the info on this kid or even better yet your insurance company should call the police and tell them what laws the kid broke. Also consult a lawyer and see if you can get monitary damages since it was his fault and he should pay.

bigmack: he wasnt that clever since he gave the info as well to the police which in turn is a crime and could land you in jail (which obviously he won't). He will most likely pay a fine if you do everything correctly Synth.

^ yes. thats giving false information and the cops will want his candy ass pretty badly for it. because he lied to em personally. that pisses em off

some thing like this happend to me when i was like 17, in the state of illinois. guy that ran into my driver side door didnt have any insurance at all. it happend on a country back road and since he was scared of the cops coming because he had no insurance he wanted to take off and my friend and i wanted to take off cause we had way too much weed on us to be driving around with. the dumbass was driving way too fast in the first place for a guy who had his girl and his infant child in his car.

we exchanged info and everything, i went home called the police, had to drive back out there to the scene to meet the sheriff, tell my story etc. long story short, i had to pay a deductable ( i think) to my insurance company, they fixed my car, and the insurance company went after dude who turned out to have a warrent out for him anyways. about a year later i got the money back that i put down on the deductable.
 
some fucker pulled out at a junction infront of me earlier turning right, so i looks left to c if anythings coming.. i look right he fuckin reversing bastard backwards to do a u turn as im edgin forward n scraped the front of my bonnet n bumber, quite a big scratch, the cunt was fuckin drunk when he got out of the car but i had no insurance i need to replace bonnet anyway so i said it dont matter theres no damage to yours and im replacing bonnet anyway, hes like ok but id like an opology, im like it wa u who reversed into me ya mad head, hes like oh ok starts laughing and gave me an hug, crazy bastard :p
 
I keep calling the police and they keep telling me the same thing. That my insurance has to handle it.

They say that my insurance company has the responsibilty of going after the kid, well he's not really a kid, he's 18, which classifies him as an adult.

But the thing is, my insurance company is only responsible for going after his insurance company to make sure that he pays up, that would be if he had insurance, but since he doesn't there isn't really anything the insurance company can do.

The police are constantly telling me that there isn't anything they can do, and I should just pay my deductible and drop it. But I don't want to.

He really slammed into me, and I had kids in the car. We could have all been killed and I just don't want him to get away with it. Next time maybe someone will get killed, God forbid.

Babygirl those pigs are bullshitting you, you in Il im in MI i think we have basically the same Car Insurance laws (no Fault Ins) anyway it is a misdormenor to supply false insurance information to the police or the dmv, punishable by not less then 1 year in jail or a $1,000 fine or both. Look on your Insurance card it should have that on there, then take it up there an tell them get off their fat ass an do their job, sorry i hate cops, but fa real they need ta step away from the doughnuts an do their job. Anyways, I knew it was illegal, I just didn't know what the punishment was, thanks for the information, i'm going to check my insurance papers right now!

the police are not bullshitting you. handle it through your insurance company like i said. your insurance company will go after the guy even if he does not have insurance. read my post, i know for from experience
 
But my insurance company told me that there isn't anything they can do. They said if he doesn't have insurance the advice they would give me is just to pay my deductible and get the car fixed, they said it's up to the police to go after the kid.

You see how nice police officers are if you treat them with respect. 4 different officers gave synth help and great advice.

btw synth I was right about seeking damages after all. l33t. :)
Our charges involve expensive fines, mandatory loss of drivers license and it makes it EASY if you have to go after them in civil court.
