WASHINGTON (AP) - The House on Wednesday approved a constitutional amendment that would give Congress the power to ban desecration of the American flag, a measure rejected twice by the Senate in the past decade but expected to get a closer vote this year.

By a 286-130 vote - eight more than needed - House members approved the amendment by the required two-thirds majority after a debate over whether such a ban would run afoul of the Constitution's free-speech protections.

If approved by a similar two-thirds majority in the Senate, the amendment would then move to the states for ratification. It would have to be approved by three-fourths, or 38, of the 50 state legislatures to become the 28th amendment to the Constitution.

Sixty-three senators, four short of two-thirds needed, voted for the amendment in 1995 and again in 2000. With Republicans increasing their majority in last fall's election, activists on both sides of the issue said the amendment has its pass chance ever of passing this year. But a rough count by The Associated Press shows 34 - one more than needed to defeat it - either as having voted against the amendment in the past or committed publicly to opposing it.

Supporters said the measure reflected patriotism that deepened after the Sept. 11, 2001 terrorist attacks, and they accused detractors of being out of touch with public sentiment.

"Ask the men and women who stood on top of the (World) Trade Center," said Rep. Randy (Duke) Cunningham, R-Calif. "Ask them and they will tell you: pass this amendment."

But Rep. Jerrold Nadler, D-N.Y., said, "If the flag needs protection at all, it needs protection from members of Congress who value the symbol more than the freedoms that the flag represents."

The measure was designed to overturn a 1989 decision by the Supreme Court, which ruled 5-4 that flag burning was a protected free-speech right. That ruling threw out a 1968 federal statute and flag-protection laws in 48 states. The law was a response to anti-Vietnam war protesters setting fire to the American flag at their demonstrations.

The proposed one-line amendment to the Constitution reads, "The Congress shall have power to prohibit the physical desecration of the flag of the United States." For the language to be added to the Constitution, it must be approved not only by two-thirds of each chamber but also by 38 states within seven years.

Each time the proposed amendment has come to the House floor, it has reached the required two-thirds majority. But the measure has always died in the Senate, falling short of the 67 votes needed.

But last year's elections gave Republicans a four-seat pickup in the Senate, and now proponents and critics alike say the amendment stands within a vote or two of reaching the two-thirds requirement in that chamber.

By most counts, 65 current senators have voted for or said they intend to support the amendment, two shy of the crucial tally. More than a quarter of current senators were not members of that chamber during the last vote.

The Senate is expected to consider the measure after the July 4th holiday.

With all due respect, nationalism is not my thing, and you know my answer. I don't see people in terms of color or nationalities, and therefore, I have no respect for a single flag. I don't have any respect for a flag from any country.

I don't believe in people forming groups, counties, states, countries, etc. An American is not any more important to me than a German and visa versa.

Anyhow, burn the flag, if you'd like to do so. If I want to burn a flag, I'll burn it..not because I think it means something, but because it will piss off people from a certain country.

I don't think it should be prohibited because people should be able to do whatever the fuck they feel like doing. If people are pissed off at USA of course they're gonna burn the flag because if they do anything more, against the government they know they'll either get killed or go to jail.

I think that two hands should be used at all times when handling the American flag, in a manner signaling respect and reverence. Ensure that the American flag is not placed in offensive areas such as the floor, near the toilet or sink, near the feet, or dirty/wet areas.

If you feel like burning flags than burn you own flag, if you got issues with a certain country, burning its flag just shows how big of a coward you are. Being an Arab i think its safe for me to say that we burn about a 100 times more flags than the rest of the whole fucking world put together, It's all we're fucking good at.

It sickens me when i see Arabs a population of over 300 million do fuck all but burn flags and dolls that look better than Bush himself after we get bombed, murdered and occupied. what the fuck are we/you accomplishing by burning a rectangular knitted fabric? we burn the U.S and Israeli flag on a daily bases while Americans and Israelis laugh their asses off at us watching the shit on CNN or Fox

I think it's ridiculous to prohibit flag burning. What's it going to do? It's not going to stop the evil terrorists.

It's hypocritcal as well. So in the States, i can't burn an American flag, but if i want to torch a Haitian flag, its okay. That's bullshit. If you're going to "protect" one piece of fabric, protect the rest as well.

I'd rather they just fuck off with the bullshit.

Prohibit or not, I would never burn any flag or respect the burning. Simply because, by burning the flag of a differnet country you are not 'gloryfiying' your country or your culture/ religion.

If I burn the flag of USA then a million Americans is going to hate and be against the reason that I burned it for. That can't be a good thing, nor is it a suitable way of bringing the issue to a worldwide audience.

Is there anything more we could possibly do?Only a few months ago, someone went as far as condemning the US for it's war on Iraq and supporting Israel in public and burned the American flag, and the King of Jordan himself asked for him to be arrested for dissing Jordan's number 1 supporter and funder.
Take the Jordanian-Israeli borders for example.It's mostly protected by Jordanians.There's no way in hell a militant'd cross the border.What can we do?Burn the Jordanian flag?We'd prolly get hung for that shit.Burning the American flag was enough to get someone a time in prison.People express their anger by burning flags, as there's nothing more they could possibly do.
And burning you're country's flag is not something you'd laugh at.Imagine seeing protesters burning the Saudi flag, which has "la illah illa Allah, muhammadun rasul allah".It's not something I'd laugh at.

This man ha ssaid the most reasonable thing I've read in this thread.

Would I ever burn the flag? No. It's disrespectful, and it doesn't accomplish anything.

Do I think there should be an amendment against it? No, and for the same reason. Stopping people from burning the flag doesn't stop them from disaggreeing with something.

My problem is that people are valuing the stupid thing more than the important ones. Why are we so eager to protect the flag, but we fail to protect the values that it represents? America is not one man, or one congress, or one court, or whatever collection of people that happen to be holding office at the time. America is the Constitution, and that never changes. So why do we let acts pass that shit all over it? Why do we get all up in arms when someone desecrates a symbol, but not when someone desecrates the thing that that symbol represents?

My view is that there are more important issues than flag burning. If the federal government is so worried about someone desecrating America, they should stop doing it themselves.
