Apple is claiming that prototype was around a couple months before sony's and also as of now the judge isn't going to let samsung use this in the case, but samsung has appealed it.

The above prototype I posted was made by Apple, a direct copy of Sony designs even still with a Sony logo (they just replaced 'S' with 'J').

I know. I'm saying Samsung isn't allowed to use the Sony argument right now. Which sucks cus I think its good evidence of Apple holding patents for nothing new, which the majority of theirs are

Ermmmm... Did you guys even read the article? "A couple months before Sony's" what? "A direct copy of Sony"'s what?

"It's important to note here that this design is not based on any actual Sony product but a mere result of Apple designers putting themselves in the shoes of Sony's designers and making something Sony's designers would. Sony themselves never made a product that looked like this."

They had an idea for a device and went out and said, ok, looks wise, how would a company like Sony make the product look? That isn't copying anything.

Outside of Macbooks I dont use Apple products but come on, Apple didnt copy Sony.

Going back to the linked article you all failed to actually read:

"Now the point of all these images is that Samsung wants to use them to prove in the court that Apple too used inspiration in designing their products. But if that's the argument they are going to make then it must be said it's a weak one. Unlike Apple's design that weren't based on any actual product and never actually shipped, Samsung has been accused of selling products that copy the designs of actual Apple products that are on sale right now."

By copying Apple's designs. Do they mean the rectangle with rounded edges? Because if so..... Apple copied the design of my sandwich to make the iphone....!

I agree that Touchwiz looks like iOS. But.... I don't think that is what Apple are going after.

But Apple could use the argument that it was "inspired by nature." A lot of companies do that, from furniture to cars. But "inspired by another company inspired by nature" sounds a bit of a stretch. Not saying Apple used nature, but an example.

And I think Apple is going after stock Android, not custom UIs. Wasn't HTC in this lawsuit? If they were, it wasn't after Sense, was it? Because that's pretty unique. Too bad HTC might go down.

Poor Motorola ate shit after the buyout/merger with Google. I see nothing on their front. Google really did just whore them out for patents.

Samsung have to pay $1.04billion in damages for infringing on 2 patents on every iPhone (apparently).

Also, in South Korea Apple and Samsung infringed on each other and as a result have to stop retailing certain devices.

I think the fact that Apple Inc. is American and Samsung is Korean influenced the courts and the justice system in America. Samsung will appeal the ruling.

Samsung's statement:

"Today’s verdict should not be viewed as a win for Apple, but as a loss for the American consumer. It will lead to fewer choices, less innovation, and potentially higher prices. It is unfortunate that patent law can be manipulated to give one company a monopoly over rectangles with rounded corners, or technology that is being improved every day by Samsung and other companies. Consumers have the right to choices, and they know what they are buying when they purchase Samsung products. This is not the final word in this case or in battles being waged in courts and tribunals around the world, some of which have already rejected many of Apple’s claims. Samsung will continue to innovate and offer choices for the consumer."

To add, something feels off. Someone posted this in regards to the deliberations. I'm no law students, and I'm not sure how accurate this all is, but if it is the case. Seems like the jury just didn't give a shit and went through it all just for the sake of it.

Deliberations began @9:00 AM 08/22/2012[1]
Deliberations were extended by one hour on 08/23/2012[2]
Deliberations ended @ 2:35 PM 08/24/2012[3]
Day 1 @ 9:00 AM - 4:30 PM = +430 minutes
Day 2 @ 8:30 AM - 5:30 PM = +540 minutes
Day 3 @ 8:30 AM - 2:35 PM = +365 minutes
Assume 10 minutes opening & 10 minutes closing remarks/verbal jury instructions from judge * 2.5 days (ignore closing on last day) = -50 minutes
Assume a very conservative 30 minutes per day to eat and use the restroom * 3 days = -90 minutes
Read jury instructions - 109 pages[4] @ approximately 24,660 words (I copy/pasted the PDF to word) @ average reading speed 280 words per minute[5] = -88 minutes
Deliberate 700 questions (and complete 20 page verdict form[6] (-45 minutes)) in remaining 1062 minutes == 91 seconds per question
The jury never asked a single question since Wednesday. It never asked for clarification on a single element of jury instructions, it never asked to have any testimony re-read.... nothing.[7]

Remember when a phone just fucking made phone calls and it was expensive as shit? So you'd think ten times before texting back with "k" like a little faggot? I miss those days. None of this shit would have happened if we were rocking Nokia's the size of Mandingo's dick.

So.....

Why are they calling it the iphone 5? It should be called the iphone 4 S S. Which is ironic, because the way Apple have been acting it rather like Nazi Germany.

Also....

I reckon the US courts will say that the HTC and Samsung patents are invalid due to FRAND... Because it is pro Apple; bought and paid for.

Yeah, outside of the US is where they will have issues. Although one US judge has already said Apple is going to have a bit of trouble. That jury in the Apple Samsung case was so so bad.

It's funny. From the 3gs all the way up to this new iphone people have been disappointed with em and say they're nothing new but they still sell so fucking much. Stupid Americans

I disagree. The 3GS to 4 was a huge change. Retina display, faster CPU, and an all-new body design. I would say after the 4 was released, it has all looked the same and spec bumps are pointless and behind the times. And I don't like most of the "new" features they've announced since the 4, including Siri. I don't think my sister ever uses it, yet she's always on her phone for shit other than texting and calling.

I'll have to ask her again what features she enjoys about her 4S and see.
